Terms & conditions

Clear expectations, no surprises. These terms cover website design and managed services supplied by Lee Searle, trading as foxes.company, based in Penzance, Cornwall.

1. Your project agreement

Your written quote or agreed order sets out the work, price, payment plan and any specific conditions. These terms sit alongside it; a specific written agreement takes priority if the two differ. Please ask about anything unclear before approving paid work. Contact theden@foxes.company.

2. Free previews & approval

Your initial working preview is free and carries no obligation to buy. Registering interest in a pitch does not commit you to a paid project. Paid work starts only after we agree the scope and price and you approve proceeding.

Please check the content, contact details and functionality before launch. Launch timing depends on receiving the information, approvals and payments agreed for your project.

3. Prices & payments

One-page starter sites begin at £295. Larger builds are quoted individually; a £0-up-front monthly option may be agreed instead. Your quote confirms the total payable, any applicable tax, recurring charges and any minimum term before you commit. Prices are in pounds sterling.

Payments are processed by Stripe. Hosting and small text edits are included in the agreed live service; extra pages, new features, substantial redesigns and additional services are quoted separately. Annual hosting costs ten times the monthly hosting fee, giving two months free.

Where upgrade instalments are offered, the agreed upgrade balance is spread over twelve hosting payments. The final instalment may be adjusted for rounding; afterwards hosting returns to its standard fee. Annual hosting clients pay upgrades as one-off purchases.

4. Hosting, The Den & support

The Den provides access to the tools enabled for your service, such as messages, enquiries, invoices and website changes. Keep your access link and sign-in details private and tell us promptly if they are compromised.

We take reasonable care to keep your service available, but uninterrupted operation cannot be guaranteed. Maintenance and outages at hosting, domain, email, payment or other providers can affect availability. Search rankings, visitor numbers, enquiries and sales are not guaranteed.

5. Missed payments

If a payment fails, there is a seven-day grace period from the first unresolved failed payment. If it remains unpaid after that period, the live website may be temporarily paused with a discreet maintenance message. Connected enquiry and email services may also pause.

Use The Den to check and settle outstanding invoices, or contact us if you need help. We aim to restore affected services promptly once payment is confirmed. A failed payment does not itself cancel your agreement.

6. Your content & ownership

You remain responsible for the accuracy and legality of the content you supply, including permission to use photos, logos, fonts and other materials. You retain your rights in your own content and allow us to use it to deliver your project.

Your project agreement should confirm ownership or licensing of the finished design and code, domain arrangements and any handover requirements. Third-party software and assets remain subject to their own licences. We will agree any paid transfer or migration work with you first.

7. Changes, cancellation & refunds

Contact us in writing to request changes or cancel. Any minimum term, notice period or remaining instalments must be set out in your agreed order; no new minimum term is created by this page. We will explain any outstanding agreed charges and handover arrangements before closing the service.

Refunds depend on the agreed work, the services already supplied and your legal rights. Nothing here removes statutory consumer rights. If you buy as a consumer rather than for your business, any applicable distance-selling cancellation rights still apply; starting work during a cooling-off period requires the appropriate agreement.

8. Referral rewards

Eligible live clients can earn a £50 cash referral reward for a referred new paying client after three continuous active months. Rewards are checked and paid manually by bank transfer, once per eligible referral. Any new-client discount must be confirmed in their quote.

9. Privacy & client enquiries

Our Privacy Policy explains how we handle personal information. You are responsible for your own business’s privacy notices and lawful use of customer details collected through your website. If we process customer data on your behalf, any required data-processing agreement should be agreed alongside your service.

10. Responsibility & resolving problems

We will provide services with reasonable care and skill. Tell us promptly about a problem so we can investigate and put it right. Neither party is responsible for delays caused by events reasonably outside its control.

Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any liability or rights that cannot legally be excluded. These terms are governed by the law of England and Wales, without overriding any mandatory consumer protections or rights to use your local courts.

Material changes to an existing paid agreement will be communicated to you; an update to this page does not silently change your agreed price or project scope.
